The Supreme Court’s IEEPA Tariff Ruling: Next Steps, Potential Refunds, and Guidance for Businesses

The U.S. Supreme Court’s 2026 ruling that invalidated tariffs imposed under the International Emergency Economic Powers Act marked a major turning point in global trade. The Court determined that the law does not clearly authorize the president to impose tariffs, leading to a decision that effectively eliminated these duties and triggered a large-scale refund process for businesses.


Following the ruling, the U.S. Court of International Trade ordered that affected importers should receive refunds of previously paid tariffs. In response, U.S. Customs and Border Protection developed a new digital system called CAPE to manage the process and handle the massive volume of claims.


CAPE officially launched on April 20, 2026, and allows importers and customs brokers to submit refund requests electronically through the Automated Commercial Environment. However, refunds are not automatic. Businesses must actively file claims and ensure their data is accurate before submission.


The first phase of the system focuses mainly on unliquidated entries and those processed within a recent time window. This phase is expected to cover a majority of eligible cases, while more complex entries will be addressed in later stages.


Despite the progress, several challenges remain. The system is under heavy demand, and technical issues have already been reported due to the large number of users. In addition, not all entries are currently eligible, and some cases may require manual review, which could delay refunds.


Refund processing is expected to take approximately 60 to 90 days after submission, depending on the complexity of the claim and any compliance checks required.


For businesses, the key priority is preparation. Companies should carefully review their import entries, identify any errors, and ensure they have access to the ACE portal. Filing claims early, maintaining accurate documentation, and monitoring deadlines are essential steps to maximize potential refunds and avoid delays.


In conclusion, the IEEPA tariff ruling creates a significant opportunity for importers to recover duties, but the process is complex and phased. Businesses that act quickly and follow official guidance will be best positioned to secure refunds and navigate the evolving regulatory environment.
